Capitulations


The capitulations are contracts of a public nature for which the Crown of Castile entrusts to a caudillo the accomplishment of a certain public service, either to discover (in naval or terrestrial form), to settle or to rescue. The crown can demand by legal action the capitulant leader that fulfills what has been committed, the obligation that the crown assumes has the legal nature of natural obligations (they do not give action to demand their fulfillment), then there is no action by the Crown. capitulant regarding the crown, but if the Crown complies, it is actually fulfilling the obligation it assumed.

They stipulated what was wanted to be fulfilled and finally what was fulfilled. Among these, the voyage from Columbus to the Indies or to America was a capitulation in which Colón himself and his group of travelers undertook to bring samples or proofs of their voyages, in order to continue on the following voyages. Thanks to these capitulations was that different states realized some of the lands that they needed and belonged to them, as well as some that they had to deliver.
